The Promotion

1. By entering the Promotion you (the “Participant”) agree to be bound by these terms and conditions.

2. The Promotion will be open from 00:00 on 27 May 2024 until 23:59 on 14 July 2024 (“Promotion Period”).

3. Please do not enter outside of the Promotion Period. Entries submitted outside of the Promotion Period will not be valid and will automatically be disallowed from the Promotion.

4. The Promotion is free to enter and no purchase is necessary.

5. A valid Instagram account required to enter and you must ensure you have the account holder’s permission if you are not the account holder.

How to enter

6. To enter the Promotion, Participants are required to take a picture of themselves next to the cardboard standee of the England Players and post on their Instagram account with the #NHplayerpose and tagging @nuffieldhealth.

7. A maximum of one entry per Participant is permitted. Where more than one entry is submitted per Participant then only the first entry will be counted as part of the Promotion and any additional entries will be disallowed.

8. Entries submitted on behalf of another Participant and joint submissions are not permitted and will be disallowed.

Prize

9. There will be one prize winner. The winner of the Promotion will win an England Football Team shirt signed by members of the Men’s Senior Team.

Winner selection process

10. The winner will be randomly selected from all valid entries received during the Promotion Period within five (5) calendar days of the end of the Promotion Period.

11. The winner will be notified via direct message on the social media account that they used to enter within two (2) calendar days of the winning entry being selected.

12. Within forty-eight (48) hours of the winner confirmation direct message, the winner must confirm their acceptance of the prize and provide their name and address the prize should be delivered to by responding via direct message to the Promoter.

13. If the winner does not accept the prize and provide all requested details within forty-eight (48) hours of the winner confirmation direct message being sent, the winner will forfeit the prize and the Promoter reserves the right to reallocate the prize to another Participant.

14. The prize may not be claimed by a third party on behalf of the winner.

15. Please allow 28 days for the physical prize to be delivered.

Publicity

16. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation, the Promoter will send surname and country of residence of the winner to anyone who sends a request and SAE to Marketing & Communication, Nuffield Health, Epsom Gateway, Ashley Avenue, Epsom, Surrey, KT18 5AL within 30 days of the end of the Promotion Period.

17. The winner consents to sharing their surname and country of residence to anyone who makes such a request with a SAE to Marketing & Communication, Nuffield Health, Epsom Gateway, Ashley Avenue, Epsom, Surrey, KT18 5AL within 30 days of the end of the Promotion Period. If you object to any or all of your surname and country of residence and winning entry being published or made available, please contact the Promoter at local.marketing@nuffieldhealth.com. In such circumstance, the Promoter must still provide the information and winning entry to any statutory or regulatory body upon request or otherwise as required by law.

Data protection

18. The Promoter will only use the personal details supplied for the administration of the Promotion and not for any other purpose unless the Promoter has your explicit consent. The Promoter may disclose Participants’ personal information to its contractors and agents to assist in conducting this Promotion or communicating with Participants. General

19. The decision of the Promoter regarding any aspect of the Promotion will be final and binding, and no correspondence will be entered into about it.

20. The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. No cash alternative is available.

21. The Promoter will not amend any contact information once the Participant has submitted their entry.

22. Entries must be made by Participants personally and must not be made through agents or third parties or, except as may be expressly permitted by these terms and conditions, through any automated process or means. Proof of identity may be requested by the Promotor.

23. The Promoter does not take any responsibility for entries which are lost, delayed, corrupted, damaged, misdirected, or incomplete or which cannot be delivered for any technical, fault, site failure, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to any link, website, online platform or other entry method for the Promotion. Any incomplete entries or entries that have not been submitted will not be considered valid for entry into the Promotion.

24. The Promoter seeks to run a fair and secure Promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entry (and any entry made using any alias of or associated with you) will be disqualified. Any prize awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions at its discretion. For this reason, the Promoter reserves the right at any point to:

a) Verify the eligibility of Participants and/or provisional winner by requesting such information it considers reasonably necessary for this purpose. Entry or a Prize may be withheld until verification is completed.

b) Disqualify entries that are not made directly by the Participant entering the Promotion.

c) Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.

d) Disqualify bulk entries from trade, consumer groups or third parties, incomplete entries and entries submitted by macros or other automated means.

e) Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, multiple SIM cards for text entries, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.

f) Disqualify Participants who tamper with the entry process.

g) Disqualify entries which, in some other way, do not meet the requirements of these Terms & Conditions.

h) Without liability, hold void, cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.

25. Any entries judged by the Promoter (in its absolute discretion) to have cheated will be disqualified from the Promotion.

26. The Promoter will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances.

27. By entering the Promotion, the Participant agrees to release and hold harmless the Promoter from any liability whatsoever for any actions, claims, demands, proceedings, costs, expenses, injuries, liabilities, losses or damages of any kind arising out of or in connection with the Promotion or with the acceptance, possession, attendance at or use of the prize (except death or personal injury caused by the Promoter’s negligence, for fraud, or otherwise as prohibited by law).

28. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using a prize, except for any liability which cannot be excluded by law. Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.

29. These terms and conditions are governed by the law of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.

30. This Promotion will be run by the Promoter and is not in any way administered by The Football Association (“The FA”) and by entering, you acknowledge and agree that The FA shall not have any liability to you in connection with the Promotion.

Eligibility

31. The Promotion is only open to residents of the United Kingdom aged 18 or over at the time of entry who are current Fitness & Wellbeing Gym members of the Promoter. All employees or agents of the Promotor or any professionally connected to this Promotion are not eligible to participate in the Promotion.
