1. Participants agree to these terms (the 'Terms’). Any information or instructions published by Nuffield Health, with its registered offices at Epsom Gateway, Ashley Avenue, Epsom, Surrey, KT18 5AL, or its fully owned subsidiaries about the Promotion (defined below) at www.nuffieldhealth.com/refer-a-friend form part of the Terms.

THE PROMOTION
2. Participants who:
(a) Are existing members of any of the Participating Fitness and Wellbeing Centres (defined below), having held a paying adult membership for at least 30 days and/ or have paid the membership fee by direct debit (‘Participant’);
(b) refer a friend to Nuffield Health (‘Referral’) who between 1 December 2021 and 30 December 2021 (‘Promotion Period’) purchases a Qualifying Membership (defined below) will be eligible to receive £50 cashback (‘Reward’), subject to these Terms (the ‘Promotion’).

• Annual pre-paid Adult (18+) (Discounted Pre Paid)

The referring member can refer a friend to any Nuffield Health Fitness and Wellbeing Centre
Rolling Monthly (standard monthly), complimentary, employees and their partners, juniors are excluded from this Promotion.
Excluded Fitness and Wellbeing Centres: City, Moorgate, Canary Wharf and Barbican.

ELIGIBILITY
3. The Promotion is only open to qualifying members in the UK aged 18 years or over, except:
(a) employees of Nuffield Health or its holding or subsidiary companies;
(b) employees of agents or suppliers of the Nuffield Health or its holding or subsidiary companies, who are professionally connected with the Promotion or its administration4. Businesses are excluded from participating in this Promotion.

4. A claim must be made by the Participant, and must not be:
(a) submitted through agents of a Fitness and Wellbeing Centres;
(b) automatically generated by computer;
(c) completed by third parties or in bulk; or are
(d) illegible, have been altered, reconstructed, forged or tampered with.


5. A maximum of three Referrals per Participant is permitted. Only one (1) claim per Referred Qualifying Membership is permitted. This Promotion cannot be used in conjunction with any other Nuffield Health promotion.

6. The following exclusions (‘Exclusions’) apply to this Promotion and in the event that one or more Exclusions apply to a Claim that Claim will be rejected and no Reward will be paid:
Participant’s membership must not:
(a) be for a Fitness and Wellbeing Centre that is not a Participating Fitness and Wellbeing Centre;
(b) have expired;
(c) be subject to a freeze;
(d) have started less than thirty (30) days before the date of Registration (defined below) submission or not have had at least one (1) successful direct debit taken (whichever is earliest);
(e) be anything other than an adult (18+) membership;
(f) be a corporate or company funded membership- the Participant must be the membership fee payer;
(g) be subject to termination following notice given by the Participant with termination to occur on or before 31 December 2021;
(h) be a complimentary or employee discounted membership;
(i) be in arrears or subject to any missed payments/ failed direct debits.


Qualifying Memberships must not:
(a) Have joined or started before or after the Promotion Period ;
(b) be subject to a freeze;
(c) be anything other than an adult (18+) membership;
(d) be a corporate or company funded membership- the Participant must be the membership fee payer;
(e) be in arrears or subject to any missed payments/ failed direct debits;
(f) be a rolling monthly (SM) membership;
(g) be subject to termination following notice given by the Referred member with termination to occur within 30 days of the Qualifying Membership start date.

ENTRY
7. Participants must first register (‘Registration’) to take part in the Promotion at www.nuffieldhealth.com/refer-a-friend. Successful Registration must take place on or before the Qualifying Membership start date during the Promotion Period. Participants who have not completed Registration on or before the Qualifying Membership start date shall not be eligible to claim a Reward.

8. Participants must submit a claim for the Reward between 30 and 60 days from the Qualifying Membership start date (Qualifying Membership start date shall count as day 1).

9. Participants have until 23:59 on day sixty (60) (as calculated at Term 9 above) to complete and submit the claim form available at www.nuffieldhealth.com/refer-a-friend (‘Website’). In order to complete the claim form, the Participant must provide the details requested including their details of their bank account located in the UK where the Reward shall be paid. Complete claim form information must be received on or before 23:59 on day sixty (60) (as calculated at Term 9 above) to be eligible to claim for a Reward. 10. The Reward is not negotiable or transferable and cannot be applied to membership fees.

11. The Administrator (defined below) will transfer the Reward within thirty (30) calendar days of successful claim validation, to the bank account provided by the Participant in the claim form.

12. If a claim is deemed not to have been submitted correctly, the Participant will be notified via email and offered the opportunity to provide the required information within seven (7) calendar days of receipt of the email. If no response is received within seven (7) calendar days of the email being sent, then the claim shall be marked as invalid and the Participant will no longer be eligible to receive the Reward. It is the Participant’s responsibility to contact us if the Participant has not received an update on the status of the Participant’s claim within seven (7) calendar days.

13. Subject to Term 13 above, claims that are incomplete will be deemed invalid. Neither Nuffield Health or the Administrator shall be responsible for lost, delayed or damaged data which occurs during any communication or transmission of claims.

14. Nuffield Health reserves the right to withdraw, suspend or amend the Promotion or these Terms and to disqualify claims which it considers do not comply with these Terms at any time at its own discretion. Nuffield Health’s decisions regarding all promotional matters will be final, and no correspondence will be entered into.

15. Nuffield Health and the Administrator shall have the right, where necessary, to undertake all such action as is reasonable to protect themselves against fraudulent or invalid claims including, without limitation, to generate or require further verification as to proof of purchase, as well as the identity, age, and other relevant details of a Participant, deny issuing the Reward, or terminate the Promotion due to the possibility fraud. This process may involve Nuffield Health sharing information with third parties.

GENERAL
16. Insofar as is permitted by law, Nuffield Health, the Administrator and their agents or distributors will not in any circumstances be responsible or liable to compensate Participants or accept any liability for any loss, damage, personal injury or death occurring in connection with the Reward except where it is caused by the negligence of Nuffield Health, the Administrator and their agents or distributors or that of their employees. Your statutory rights are not affected

17. Data Protection: Personal data provided by the Participant when making a claim under this Promotion shall be processed in accordance with Nuffield Health’s Privacy Notice at https://www.nuffieldhealth.com/privacy

19. These Terms shall be governed by English Law and is subject to the exclusive jurisdiction of the English courts.
